Guardianship

Action seeking appointment of a guardian for an adult based upon the best interests of the proposed protected person plus a court finding that the decision-making capacity of the person is so impaired that (s)he is unable to care for his or her own safety, or to provide for necessities such as food, shelter, clothing, or medical care without which physical injury or illness may occur.

Conservatorship

Action seeking appointment of a conservator for an adult based upon the best interests of the proposed protected person plus a court finding that the decision-making capacity of the person is so impaired that (s)he is unable to make, communicate, or carry out important decisions concerning his or her own financial affairs.

Medicaid Compliant Caregiver Agreement

Agreement between a person who needs care and a person who is willing to provide care for compensation with such payment being considered a fully compensated transfer for Medicaid eligibility purposes.
